Terms of Use for BuilderFive
Effective Date: July 1, 2025
Welcome to BuilderFive! These Terms of Use ("Terms") govern your access to and use of the BuilderFive mobile application (the "App"), operated by BuilderFive ("we," "us," or "our"). By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and are legally permitted to enter into this agreement.
2. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials secure
- Notify us immediately of any unauthorized use of your account
You are solely responsible for all activities under your account.
3. Use of the App
We grant you a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms. You agree not to:
- Copy, modify, or distribute the App
- Reverse-engineer or attempt to extract the source code
- Interfere with or disrupt the App's functionality
4. User-Generated Content (Places, Photos, Descriptions)
You may submit content such as place descriptions and photos ("User Content"):
- You retain ownership of your content
- You grant BuilderFive a perpetual, worldwide, royalty-free license to use, display, distribute, and reproduce your User Content in connection with the App
User Content must not:
- Infringe on copyrights or intellectual property
- Contain nudity, hate speech, violence, or illegal material
- Mislead users or misrepresent historical information
Created places and their content are permanent and cannot be modified or deleted after submission, unless your account is deleted. BuilderFive reserves the right to remove User Content that violates these Terms.
5. Location Tracking
The App relies on location data to function:
- Foreground tracking is required for place discovery and navigation
- Background tracking is optional and enables coin rewards when you are in a sponsored zone while the app is closed or minimized
You can toggle background tracking in the Settings menu.
6. Coins and Rewards
BuilderFive rewards users with in-app coins for certain actions:
- 20 coins per minute in sponsored zones
- Coins for discovering or creating places based on rarity
Coins may be cashed out via Venmo. We reserve the right to:
- Adjust reward rates or coin values
- Deny payouts for suspected fraudulent behavior (e.g., GPS spoofing)
Coins have no cash value unless explicitly converted through approved payout methods.
7. Termination
We may suspend or terminate your account at our discretion for violations of these Terms. You may also delete your account at any time. Deleting your account removes your personal data and your created places.
8. Analytics and Third-Party Services
We use Google Analytics and other third-party tools to monitor usage and improve the App. These tools may collect information about your device and interactions within the App.
9. Intellectual Property
BuilderFive and its content (excluding User Content) are protected by copyright and other laws. You may not use BuilderFive's branding or proprietary materials without permission.
10. Disclaimers and Limitation of Liability
The App is provided "as is" without warranties of any kind. We are not liable for:
- Lost data or earnings
- Availability or reliability of zones or rewards
- Errors or interruptions in the App
Your use of the App is at your own risk.
11. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
12. Changes to These Terms
We may modify these Terms at any time. Continued use of the App after changes indicates your acceptance of the updated Terms.
